Builders liability insurance holders have been warned after the prosecution of a building company relating to a workplace transport incident.
Brothers Byan and Michael Kendra of L & S Kendra and Sons, Melbourne, East Yorkshire, were fined £9,000 and each ordered to pay £2,500 in costs after both men pleaded guilty to breaching Section 2(1) of the Health and Safety at Work Act 1974.
Beverly Magistrates Court heard how in July 2009, Bryan Kendra was driving a 360 degree excavator digger when it struck and drove over bricklayer Andrew Trezise.
The victim suffered a broken pelvis and serious leg injuries in the incident.
An investigation by the Health and Safety Executive (HSE) found that there were no markings to indicate where the digger was working, while a reversing assistant had not been deployed.
Geoff Clark, HSE inspector, said: "L & S Kendra and Sons failed to have proper systems in place at the site to restrict and control the movement of the digger."
Earlier this month, Macob Administration, based in Bridgend, was fined £80,000 after one of its employees had his head crushed by a digger he was not qualified to operate at a site in Gloucestershire in 2005.
